1. Acceptance of Terms
Welcome to Khora. By accessing or using our mobile application, website (mykhora.com), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
2. Definitions
- "Service" refers to the Khora app, website, and all related features.
- "User" refers to any individual who accesses or uses the Service.
- "Merchant" refers to a User who has claimed a restaurant listing or registered a business.
- "Content" refers to reviews, ratings, photos, posts, and any other material users submit.
- "We," "us," "our" refers to Khora, operated by Pess AI Technologies.
3. Accounts & Registration
- You must be at least 13 years old to create an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for safeguarding your password and for all activity under your account.
- You may not create an account using a false identity or on behalf of someone other than yourself.
- One person or entity may not maintain more than one account.
4. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any local or international law.
- Harass, abuse, threaten, or impersonate any person or entity.
- Submit false, misleading, or fraudulent reviews or ratings.
- Post content that is defamatory, obscene, hateful, or infringes on others' rights.
- Attempt to gain unauthorized access to any part of the Service, user accounts, or systems.
- Use bots, scrapers, or automated tools to extract data from the Service.
- Interfere with the proper functioning of the Service or overload it.
- Reproduce, sell, or resell the Service or any part of it without authorization.
5. User-Generated Content
- You retain ownership of the Content you submit, but grant Khora a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that Content within the Service.
- You are solely responsible for your Content and ensure it does not violate any law or third-party rights.
- We reserve the right to remove, hide, or moderate any Content that violates these Terms or our community guidelines.
- We may use AI and automated systems to analyze, summarize, and extract insights from reviews to improve discovery.
6. Merchant Terms
- Merchants must have authority to claim and manage the restaurant listing they represent.
- Merchants are responsible for keeping business information (hours, address, menu, photos) accurate and up to date.
- Merchants may not post reviews or ratings for their own restaurant or competitors' restaurants.
- Merchant subscription plans (Free, Starter, Pro, Enterprise) determine available features; see our Pricing page for details.
- Merchants must comply with all applicable consumer protection and data privacy laws.
7. Payments & Subscriptions
- Merchant subscription payments are processed by Paystack. By subscribing, you authorize recurring charges to your selected payment method.
- Subscriptions auto-renew at the end of each billing cycle unless cancelled.
- You may cancel at any time; access continues until the end of the current paid period.
- Refunds are governed by Paystack's policies and applicable law; contact us for assistance.
- We may change subscription fees with reasonable advance notice; existing subscribers keep their current rate until renewal.
8. Reservations & Orders
- Khora facilitates reservations and pickup orders between Users and restaurants but is not a party to any transaction.
- Restaurants are responsible for confirming, seating, and fulfilling reservations and orders.
- Khora is not liable for the quality, timeliness, or availability of food or service provided by restaurants.
- Users are responsible for honoring confirmed reservations; repeated no-shows may result in restricted booking privileges.
9. Intellectual Property
The Service, including its design, features, logos, and software, is owned by Khora and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. "Khora" and related marks are trademarks of Pess AI Technologies.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service. Restaurant information, ratings, and reviews represent the opinions of users and do not reflect our endorsement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Khora and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the preceding 12 months, or USD $50, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Khora, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your Content, or your violation of these Terms.
13. Termination
You may delete your account at any time through the app. We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or pose a risk to the Service or other users.
14. Governing Law
These Terms are governed by the laws of the Republic of Ghana, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ghana, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
15. Changes to Terms
We may revise these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
